We’ll also draft an agreement to mediate and establish appropriate foundations for the mediation process.

Introduction

The mediation begins with a plenary session with all parties. This joint session brings both parties together in a neutral, structured environment if appropriate. Our mediator will outline the process and principles, creating a calm and respectful place to open the dialogue and help the parties engage in the process.

3.

Storytelling

Each party is given the opportunity to describe their story and identify the issues important to them. This often follows a conflict mapping process where we help each party express their needs, concerns, and goals. Here, we work to uncover what’s really at stake so that both sides can better understand each other’s perspective and what resolution could look like.

4.

Problem solving

With a clear understanding of the issues, experiences, and expectations of each party, we move into the problem-solving phase where we explore practical solutions. This may happen in joint sessions or one-to-one discussions (caucus), depending on what’s most appropriate. We guide the conversation calmly and constructively, with a fair resolution in mind.

5.

Agreement

Where agreement is reached, we draft a heads of agreement or memo of understanding with the parties. This document captures what has been agreed in a clear, practical format, helping parties move forward and reach lasting impact with confidence and clarity. Where appropriate, the agreement can be made binding.

6.

Caucus Zone

At any stage in the process, either the parties or mediator can call a “caucus zone” where each party is provided with space to further clarify information with the mediator without the other party present. This creates a confidential space for reflection to help the parties progress matters.
